TERMS ANDCONDITIONS.

These Terms and Conditions (“Terms”) govern your use of the ALC Groundworks website and the services we provide. By using this website or requesting our services, you agree to these Terms.

1. Services: ALC Groundworks provides lawn mowing, weed whacking and edging, fertilization, core aeration, overseeding, seasonal yard cleanups and winter snow removal, to residential and commercial properties within our service areas. We do not apply herbicide, pesticide or mosquito treatment, and we do not provide tree work, irrigation or hardscaping. Availability, timing and pricing vary by location, property size and property condition.

2. Quotes and pricing: Quotes are based on the information you give us and on the property as we find it, and may be adjusted if conditions differ materially from what was described. Any adjustment is communicated to you before the additional work is done. Offers and discounts may change and may not be combinable unless we say so in writing.

3. Scheduling and property access: You agree to provide safe and reasonable access to the areas to be serviced, including unlocking gates, securing pets and clearing furniture, toys and hoses from the work area. We may reschedule for weather, ground conditions or safety. If we attend and cannot access the property, a charge may apply.

4. Underground and concealed items: You are responsible for marking irrigation heads, invisible pet fencing, shallow low-voltage wiring and any other concealed item before aeration or any work that penetrates the soil. We are not responsible for damage to unmarked concealed items.

5. Payment: Payment is due as set out in your quote or invoice. Late amounts may be subject to interest or reasonable collection costs as permitted by law, and service may be suspended while an account is overdue.

6. Cancellation: There is no contract and no minimum term. You may cancel scheduled or recurring service at any time by contacting us. Cancellation after a crew has arrived, or after work has begun, may result in a charge for work performed.

7. Service guarantee: If work we performed was missed, incomplete or done badly, contact us and we will return and correct it at no charge. This guarantee covers workmanship. It does not cover biological outcomes outside our control — in particular, seed germination depends on watering and weather after we leave, and is not guaranteed.

8. Limitation of liability: To the maximum extent permitted by law, ALC Groundworks is not liable for indirect, incidental or consequential damages. Total liability for any service claim is limited to the amount paid for that service. Nothing here limits liability that cannot be limited under applicable law.

9. Communications: By giving us your contact information you consent to communications as described in our Privacy Policy and SMS Terms and Conditions.

10. Intellectual property: Website content, photographs, graphics and the ALC Groundworks name are owned by or licensed to us and may not be used without written permission.

11. Governing law: These Terms are governed by the laws of British Columbia and the federal laws of Canada applicable there, and disputes are subject to the exclusive jurisdiction of the courts of British Columbia.
